Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of this website and all games, applications, and services published by butterssoft ("we", "us", or "our"). By accessing this website or downloading, installing, or using any of our games, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or games.
Individual games may also have their own game-specific terms and privacy policies. Where a game-specific term conflicts with these Terms, the game-specific term applies for that game.
Use of Our Games
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable license to download and use our games for your own private, non-commercial entertainment on a device that you own or control.
You agree not to: (a) copy, modify, distribute, sell, or lease any part of our games or website; (b) reverse engineer, decompile, or attempt to extract the source code of any game, except to the extent that such restrictions are prohibited by applicable law; (c) use our games for any unlawful purpose or in any way that could damage, disable, or impair our services; or (d) attempt to gain unauthorized access to any of our systems or networks.
In-App Purchases
Some of our games offer optional in-app purchases. These may include consumable items (such as in-game power-ups or credits that are used up through play) and non-consumable items (such as removing advertisements or unlocking the full game, additional content, or gameplay options).
All payments are processed by the relevant platform app store — Google Play Billing on Android and Apple's App Store on iOS — under their own terms and privacy policies. We do not receive or store your payment card details. Prices are shown in the game before you confirm a purchase and may change over time, and applicable taxes may be added. Consumable items are used up through gameplay and cannot be recovered once consumed. Non-consumable purchases are tied to your store account and/or device and grant you a limited, personal, non-transferable license to the relevant content rather than ownership of it. In-game items and virtual currency have no monetary value, cannot be exchanged for cash, and may become unavailable if we cease to offer a game.
Refunds for in-app purchases are generally handled by the platform app store in accordance with its policies, and we encourage you to contact the store directly. If you are a consumer in the European Union, the United Kingdom, or another jurisdiction granting a right of withdrawal, you normally have 14 days to withdraw from a purchase of digital content. However, by purchasing and accepting immediate delivery of digital content, you expressly request that we begin performance immediately and acknowledge that you lose your right of withdrawal once the content has been delivered or, for consumable items, once they have been used. This does not affect any mandatory statutory rights you have as a consumer.
Intellectual Property
All content on this website and within our games — including but not limited to the games themselves, source code, graphics, artwork, logos, characters, audio, text, and trademarks — is owned by or licensed to butterssoft and is protected by copyright, trademark, and other intellectual property laws. The "butterssoft" name and logo and all game titles are trademarks of butterssoft.
Except for the limited license granted to you in these Terms, nothing here transfers to you any right, title, or interest in our intellectual property. You may not use our trademarks or branding without our prior written permission.
Disclaimer of Warranties
Our website and games are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our games or website will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. Nothing in these Terms affects your statutory rights as a consumer.
Limitation of Liability
To the fullest extent permitted by applicable law, butterssoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) our website or games.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands. If you are a consumer, this does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.
